In terms of Section 4, Chapter – II of the “Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, it is mandatory for employers at all workplaces to constitute a Committee to be designated as the “Internal Complaints Committee” at all its administrative units or offices.

Accordingly, an “Internal Complaints Committee” has been formed on 2nd May, 2014, at the Administrative Office of West Bengal Infrastructure Development Finance Corporation Ltd., located at “Mangalam” Building, Block – A, 1st Floor, 24, Hemanta Basu Sarani, Kolkata 700001. The Committee consists of a senior lady executive of the Corporation as the Presiding Officer / Chairperson, while the other members of the Committee are the Head (HRD & Per) of the Corporation, a lady member of the staff, and an external lady member who is actively involved in propagating and safeguarding causes of women, and is familiar with issues relating to sexual harassment.  

The Presiding Officer and every member of the Committee shall hold office for such period as is provided for in the Act.

The Committee shall deal with all complaints of sexual harassment, institute enquiries, and make recommendations for relief in the manner provided for in the Act, and also render assistance to the complainant where the complaint cannot be made in writing. Complaints can be made either by the victim in person, or by her legal heir in case of her death, or by such other person as may be prescribed. All rights and obligations of the Committee will be in accordance with the provisions of the Act. 

It is also to be noted that no court shall take cognizance of any offence punishable under the said Act or any rules made thereunder, save on a complaint made by the aggrieved woman or any person authorized, inter alia, by the Internal Complaints Committee in this behalf.   

The Committee shall prepare an annual report in each calendar year, and submit the same to the Employer and to the “District Officer” notified by the Government for this purpose. The number of cases handled by the “Internal Complaints Committee” and their disposal under the abovementioned Act, will also be included in the Annual Report of the Corporation.”
